Information Obligation of the Controller
Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “Regulation”) in accordance with Section 19 of Act No. 18/2018 Coll. on Personal Data Protection (hereinafter referred to as the “Act”).

III. Purposes and Legal Basis of Processing
The Controller processes personal data of data subjects for the purpose of fulfilling the obligations of the school facility, in particular:
- Ensuring the educational process.
- Organizing school events.
- Sending data to the Central Register of the Ministry of Education, Research, Development, and Youth of the Slovak Republic via the School Information System – eŠkola.
- Processing for the purposes of OHS (Occupational Health and Safety), FP (Fire Protection), and OHS (Occupational Health Service).
- Processing in the area of personnel and payroll agenda.
Legal Basis of Processing
Pursuant to Section 13(1)(c) of the Act, processing is necessary for compliance with a legal obligation to which the controller is subject under special regulations, which include in particular:
- Act No. 245/2008 Coll. on Education and Training (the School Act).
- Act No. 596/2003 Coll. on State Administration in Education and School Self-government.
- Act No. 317/2009 Coll. on Pedagogical and Professional Employees.
- Act No. 597/2003 Coll. on the Financing of Primary Schools, Secondary Schools, and School Facilities.
- Act No. 311/2001 Coll. Labor Code and other related norms.
Consent of the data subject (Section 14 of the Act): Used when processing photographs, video recordings, publishing competition results, and other operations not directly required by special legal regulations.
Recipients of Obtained Personal Data
- Central Register of the Ministry of Education, Research, Development, and Youth of the SR (pupil and legal guardian data).
- School computing centers, NUCEM (pupil data).
- Social Insurance Agency, health insurance companies, supplementary pension insurance companies, pension management companies (employee data).
- Tax Office (employee data).
- State administration and public authority bodies for control and supervision purposes.
- Central Office of Labour, Social Affairs and Family (pupil and employee data).
- Courts, law enforcement agencies, executors.
- Companies that are co-organizers of school events.
IV. Retention Period and Rights of the Data Subject
The retention period of personal data is determined by the relevant law in accordance with the storage period according to the registry record.
Rights of the Data Subject
- Right of access: Upon request, the Controller shall issue a confirmation of data processing and provide a copy. The first copy is free of charge; subsequent copies are subject to an administrative fee. For electronic requests, information is provided by e-mail unless otherwise requested.
- Right to rectification and completion: The Controller shall correct incorrect or complete incomplete data without undue delay upon request.
- Right to erasure: The data subject has this right if:
- The data is no longer necessary for the original purposes.
- Consent is withdrawn and no other legal basis exists.
- The data subject objects to the processing.
- The data was processed unlawfully.
- Erasure is required by law, a special regulation, or an international treaty.
- The data was collected in connection with the offer of information society services to a person under 16 years of age.
- Exceptions to the right to erasure: The right does not apply if processing is necessary for exercising the right of freedom of expression, for compliance with a legal obligation, for reasons of public interest (health, archive, research, statistics), or for the defense of legal claims.
- Right to restriction of processing: Applies during the verification of data accuracy, in case of unlawful processing (if restriction is requested instead of erasure), or if the Controller no longer needs the data but the data subject requires it for legal claims.
- Right to data portability: The right to obtain data in a machine-readable format and transfer it to another controller (if processed automatically based on consent or contract).
- Right to object: The possibility to object due to a specific situation during processing in the public interest, the legitimate interest of the Controller, for direct marketing, or for scientific/statistical purposes.
- Right to withdraw consent: At any time by contacting the responsible person. Withdrawal does not affect the lawfulness of processing prior to withdrawal.
- Right to initiate proceedings: To the Office for Personal Data Protection of the Slovak Republic if the person believes their rights have been violated.
V. Reporting of Anti-social Activity (Whistleblowing)
In accordance with Act No. 307/2014 Coll. on certain measures related to the reporting of anti-social activity, the Arnold Ipolyi Primary School with VJM Balog nad Ipľom publishes:
